Sailracerpro End User License Agreement

1. Acceptance of Terms
This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and Sailracerprosupport LLC ("Company", "we", or "us") governing your use of our software at sailracerpro.com, including mobile and web applications (the "Software"). By downloading, installing, or using the Software, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not use the Software.

2. License Grant
Sailracerprosupport LLC grants you a personal, non-exclusive, non-transferable, limited license to use the SailracerPro.com Software for your personal or non-commercial racing use on compatible devices that you own or control, subject to the terms and conditions of this EULA.

3. Subscriptions and Payments
The Software is provided on a subscription basis. You may access a 14-day free trial to assess the suitability of the Software. Continued use after the trial period requires a paid subscription. Subscription pricing, plans, billing cycle, and cancellation terms are set out on our website or within the app. Subscriptions will automatically renew at the end of each billing period unless you cancel prior to renewal. Refunds are available only within the 14-day initial trial period.

4. Safety Warning
The Software provides GPS-based replay and live-tracking features only. It is not a substitute for professional navigation equipment, marine depth charts, maritime rules, or visual lookout. You are solely responsible for your safety on the water at all times. Safe navigation and collision avoidance remain your responsibility at all times.

5. Restrictions
You agree not to:
 * Modify, translate, adapt, or create derivative works based on the Software.
 * Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Software.
 * Rent, lease, sublicense, distribute, sell, or transfer the Software to any third party.
 * Use the Software for any illegal or unauthorized purpose, or in violation of any local, state, national, or international laws.

6. Intellectual Property
All intellectual property rights in and to the Software, including but not limited to copyrights, patents, trademarks, and trade secrets, are and shall remain the exclusive property of Sailracerprosupport LLC. This EULA does not grant you any ownership rights to the Software.

7. User Data and Privacy
Your use of the Software is also governed by our Privacy Policy, which explains how we collect, use, and safeguard your personal information. By using the Software, you consent to the collection and use of your data as outlined in the Privacy Policy.

8. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and destroy all copies of the Software in your possession or control.

9. Disclaimers and Limitation of Liability
The Software is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Sailracerprosupport LLC does not warrant that the Software will be uninterrupted, error-free, or secure. In no event shall Sailracerprosupport LLC be liable for any damages, including but not limited to direct, indirect, incidental, consequential, or punitive damages, arising out of or related to your use of or inability to use the Software.

10. Governing Law and Jurisdiction
This EULA shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles. Any disputes arising out of or in connection with this EULA shall be resolved exclusively in the state or federal courts located in Delaware.

11. Informal Dispute Resolution
If you have any dispute or claim arising out of or relating to this EULA or the Software, please first contact us at sailracerpro@gmail.com and attempt to resolve the matter informally. We will try to resolve the dispute within 60 days of receiving your written notice.

12. Amendments
Sailracerprosupport LLC reserves the right to modify this EULA at any time. Any changes will be posted on our website and will become effective upon your acceptance of the modified EULA. Continued use of the Software after the effective date of any changes constitutes your acceptance of the new terms.

13. Severability
If any provision of this EULA is held to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement
This EULA constitutes the entire agreement between you and Sailracerprosupport LLC concerning the sailracerpro.com Software and supersedes all prior or contemporaneous communications, agreements, and understandings, whether oral or written, with respect to the Software.
